By downloading, installing, or using Yocha, you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Ninchanese.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on devices you own or control
- Use the App for personal, non-commercial purposes
- Access content and features included in the App
2.2 Restrictions
You may NOT:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices or labels
- Sell, rent, lease, or sublicense the App
- Use the App for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to any part of the App
- Use automated systems (bots, scrapers) to access the App
- Upload viruses or malicious code
2.3 Updates & Modifications
We may update the App from time to time to:
- Add new features or content
- Fix bugs and improve performance
- Comply with legal requirements
Updates may be required to continue using the App. We reserve the right to modify or discontinue the App (or any part thereof) at any time without notice.
3. User Accounts & Data
3.1 No Account Required
Yocha does NOT require user registration or account creation. All progress and settings are stored locally on your device.
3.2 User Responsibility
You are responsible for:
- Maintaining the security of your device
- Backing up your progress (if desired)
- Ensuring compliance with these Terms
Note: Uninstalling the app or clearing app data will delete local progress. We cannot recover deleted data.
4. In-App Purchases & Payments
4.1 Yocha Pro (Lifetime Purchase)
The App offers an optional one-time in-app purchase: Yocha Pro (Lifetime).
Yocha Pro includes:
- Unlimited practice sessions (no daily limits)
- Unlimited Arcade mode runs
- Unlimited Gymbank storage
- Ad-free experience (future-proofing, as we don't currently show ads)
- Full access to all HSK levels
Pricing: The price is displayed in your local currency in the App Store and is subject to change.
4.2 Payment Processing
- All purchases are processed through Google Play Store (Android)
- Payment is charged to your Google Play account at confirmation of purchase
- We do NOT store your payment information
4.3 Refunds
Google Play Refunds:
- Refunds are subject to Google Play's refund policy
- Generally, refunds are available within 48 hours of purchase for most apps
- To request a refund, contact Google Play support
Our Policy:
- We do not directly process refunds
- Contact us at hello@ninchanese.com if you have issues with your purchase
- We may assist in resolving billing issues with Google Play or RevenueCat
4.4 Restoring Purchases
- Purchases are tied to your Google Play account
- Use the "Restore Purchases" button in Settings to restore Pro status on new devices or after reinstalling
4.5 No Subscription Auto-Renewal
Yocha Pro is a ONE-TIME purchase (lifetime access). There are NO recurring charges or subscriptions.
5. Free Tier Limitations
The free version of Yocha includes:
- Full access to HSK 1 lessons (unlimited)
- HSK 2-6 lessons with daily limits:
- 3 practice sessions per day
- 1 Arcade run per day
- 5 saved exercises in Gymbank
Limits reset daily at midnight (device local time).
6. Intellectual Property Rights
6.1 Our Content
All content in the App, including but not limited to:
- Lesson content and grammar explanations
- Exercises and practice materials
- Chinese sentences and examples
- App design, interface, and graphics
- Yocha mascot and branding
- Code and software
...is owned by or licensed to Ninchanese and protected by copyright, trademark, and other intellectual property laws.
6.2 Third-Party Content
Some content is derived from open sources:
- CC-CEDICT (Creative Commons Attribution-ShareAlike 4.0)
- HanDeDict (Creative Commons Attribution-ShareAlike 2.0 Germany)
- Kaikki.org / Wiktionary (Creative Commons Attribution-ShareAlike 3.0)
Appropriate attribution is provided where required.
6.3 User Restrictions
You may use lesson content for personal learning purposes only. You may NOT:
- Reproduce, distribute, or publicly display App content
- Create derivative works based on our content (without permission)
- Use content for commercial purposes
7. User Conduct
You agree to use the App in a lawful and respectful manner. You may NOT:
- Use the App to harass, abuse, or harm others
- Post or transmit unlawful, threatening, or obscene content (though the App has no user-generated content features currently)
- Violate any applicable laws or regulations
- Infringe on the rights of others
We reserve the right to terminate your access if you violate these Terms.
8. Disclaimers & Limitations of Liability
8.1 "AS IS" Basis
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Accuracy, completeness, or reliability of content
- Uninterrupted or error-free operation
8.2 Educational Content
- Yocha is an educational tool to supplement Chinese language learning
- We do NOT guarantee fluency, exam success (HSK or otherwise), or any specific learning outcomes
- Content is provided for informational purposes and may contain errors
- Always consult multiple sources when learning a language
8.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are NOT liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claim shall not exceed the amount you paid for Yocha Pro (if applicable), or $20 USD, whichever is greater
- We are not responsible for loss of data, progress, or device damage
8.4 Third-Party Services
We are not responsible for issues caused by:
- Google Play Store policies or service interruptions
- RevenueCat payment processing errors
- Firebase Analytics data collection (see their privacy policy)
- Device manufacturer or operating system bugs
9. Third-Party Links
The App may contain links to third-party websites or services (e.g., Ninchanese.com):
- We do NOT control or endorse these third-party sites
- Accessing third-party links is at your own risk
- Review their terms and privacy policies separately
10. Termination
10.1 By You
You may stop using the App at any time by uninstalling it from your device.
10.2 By Us
We may suspend or terminate your access to the App if:
- You violate these Terms
- You engage in fraudulent activity
- We discontinue the App entirely
10.3 Effect of Termination
- Your license to use the App terminates immediately
- You must delete the App from your devices
- Surviving provisions (disclaimers, limitations of liability, etc.) remain in effect
Note: Lifetime purchases (Yocha Pro) remain valid unless terminated for cause (violation of Terms).
11. Changes to Terms
We may update these Terms from time to time. When we do:
- The "Last Updated" date will be revised
- We will notify you through the App or via email (if you've contacted us)
- Continued use of the App after changes constitutes acceptance
If you do not agree to the updated Terms, you must stop using the App.
12. Governing Law & Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of France, without regard to conflict of law principles.
12.2 Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
1. Informal Negotiation: Contact us first to resolve amicably (hello@ninchanese.com)
2. Mediation/Arbitration: If informal resolution fails, we may pursue mediation or arbitration (details to be agreed upon)
3. Jurisdiction: Courts in France have exclusive jurisdiction
12.3 Waiver of Class Actions
You agree to resolve disputes individually and waive the right to participate in class actions or class-wide arbitration (to the extent permitted by law).
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ninchanese regarding the use of Yocha.
